These Terms of Service apply to your use of www.cutoutcollective.com.au and to purchases made from Cutout Collective Australia.

In these Terms:

  • “Cutout Collective”, “we”, “us” and “our” refer to Cutout Collective Australia;
  • “website” means www.cutoutcollective.com.au; and
  • “you” and “your” refer to the person accessing the website or purchasing products from us.

By accessing our website or placing an order, you agree to these Terms of Service.

Nothing in these Terms excludes, restricts or modifies any rights or remedies that cannot lawfully be excluded under the Australian Consumer Law or other applicable Australian laws.

1. Eligibility to Purchase

You must be legally capable of entering into a binding agreement to place an order through our website.

If you are under 18 years of age, you may only place an order with the involvement and permission of a parent or legal guardian.

You must ensure that all information supplied during checkout is accurate, current and complete.

2. Products

We aim to describe and display our products as accurately as reasonably possible.

Product colours and appearance may vary slightly due to:

  • screen settings;
  • lighting;
  • printing processes;
  • manufacturing tolerances; and
  • differences between promotional images and the physical product.

Measurements shown on the website are approximate unless expressly stated otherwise.

A minor variation that does not materially affect the product’s appearance, quality or intended use will not necessarily constitute a product defect. This does not limit your rights under the Australian Consumer Law.

3. Product Availability

All products are subject to availability.

Adding a product to your cart does not reserve that product. Stock is allocated when an order is accepted and payment is successfully processed.

If a product becomes unavailable after you place an order, we will contact you and offer one of the following, as appropriate:

  • a suitable alternative;
  • a refund for the unavailable product; or
  • cancellation and refund of the affected order.

We will not substitute a materially different product without your agreement.

4. Orders

An order submitted through our website is an offer by you to purchase the selected products under these Terms.

An automated order confirmation acknowledges that we have received your order. It does not necessarily mean that your order has been accepted.

We may decline or cancel an order before dispatch where reasonably necessary, including where:

  • the product is unavailable;
  • payment has not been authorised;
  • the order appears fraudulent or unauthorised;
  • delivery is not reasonably available to the supplied address;
  • a material website, pricing or product-description error has occurred; or
  • the order breaches these Terms or applicable law.

If we cancel an order after receiving payment, we will refund the amount paid for the cancelled products and any applicable shipping charges.

5. Prices

All prices displayed on the website are in Australian dollars.

Unless expressly stated otherwise, prices include Goods and Services Tax where applicable.

Product prices, promotions and shipping charges may change from time to time. Changes will not affect an order that we have already accepted, except where you agree to the change or where permitted by law.

The total price payable, including applicable shipping charges, will be displayed at checkout before you submit your order.

6. Pricing and Website Errors

We take reasonable care to ensure that product information, availability and pricing are accurate.

If a product is listed at an incorrect price or contains a material description error, we may contact you before dispatch and give you the option to:

  • proceed with the corrected information and price; or
  • cancel the affected product or order for a full refund.

We will not charge you more than the amount displayed and accepted at checkout without obtaining your agreement.

Obvious or genuine errors may be corrected, provided this is done consistently with the Australian Consumer Law.

7. Payment

Payment must be made using one of the payment methods available at checkout.

You authorise us and our payment service providers to process the payment information supplied with your order.

We may delay processing or dispatch until payment has been successfully received and verified.

You must not use a payment method unless you are authorised to use it.

8. Promotions and Discount Codes

Promotions and discount codes are subject to any specific conditions displayed with the offer.

Unless otherwise stated:

  • only one discount code may be used per order;
  • discount codes cannot be exchanged for cash;
  • discounts do not apply retrospectively;
  • expired codes will not be accepted; and
  • promotions may exclude selected products.

We may refuse or cancel the use of a promotion where it has been obtained or used fraudulently, unlawfully or contrary to its published conditions.

9. Shipping and Delivery

Shipping is governed by our separate Shipping Policy, which forms part of these Terms.

Orders placed before 1:00pm AEST on a business day are generally dispatched the same business day.

Our current shipping options are:

  • Standard Shipping: $11.95;
  • Express Shipping: $19.95; and
  • Free Standard Shipping for eligible orders over $199.

Shipping rates and eligibility conditions displayed at checkout will apply to your order.

Delivery estimates are guides only and may be affected by Australia Post network conditions, weather, public holidays, remote delivery locations and other circumstances beyond our reasonable control.

Nothing in this section limits any right you may have where goods are not delivered within an agreed or reasonable time.

10. Delivery Information

You are responsible for providing a complete and accurate delivery address.

Please contact us promptly if you notice an error in your delivery information. We cannot guarantee that an address can be changed once an order has been processed or dispatched.

Where an incorrect or incomplete address supplied by you results in a parcel being returned, redirected or resent, you may be responsible for reasonable additional delivery costs, except where the issue was caused by us.

11. Authority to Leave

Where you request or authorise a parcel to be left unattended, you accept the ordinary risks associated with that delivery instruction.

This does not exclude responsibility for loss or damage caused by our failure, or that of our delivery provider, to follow the agreed delivery instructions or exercise reasonable care.

12. Risk and Ownership

Ownership of products passes to you once we have received full payment for them.

Risk in the products passes to you when the products are delivered to you, or to a person or location nominated by you, subject to your rights under applicable law.

13. Order Changes and Cancellations

Please review your order carefully before submitting it.

Contact us as soon as possible if you need to request a change or cancellation. We may be unable to change or cancel an order once it has entered processing, production or dispatch.

Any cancellation right under this section is additional to, and does not limit, your rights under the Australian Consumer Law.

14. Change-of-Mind Returns

We do not offer returns, exchanges or refunds where you:

  • change your mind;
  • order the wrong product;
  • select the wrong size, design or character;
  • no longer require the product;
  • find the product cheaper elsewhere; or
  • fail to review the product description or measurements before ordering.

Please choose carefully before completing your purchase.

This change-of-mind policy does not limit your rights where a product fails to meet a consumer guarantee under the Australian Consumer Law.

15. Faulty, Damaged or Incorrect Products

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law.

You may be entitled to a repair, replacement, refund or other remedy where a product:

  • is faulty;
  • is not of acceptable quality;
  • is not fit for its disclosed or ordinary purpose;
  • does not match its description;
  • is materially different from what you ordered; or
  • arrives damaged.

Claims are handled under our Returns & Refund Policy, which forms part of these Terms.

We may ask you to provide your order number, photographs, video or other information reasonably required to assess the issue. This does not remove or reduce your statutory rights.

16. Major and Minor Failures

Where a product has a major failure under the Australian Consumer Law, you may be entitled to reject the product and choose a refund or replacement.

Where a failure is not major, we may choose to provide an appropriate remedy, such as a repair, replacement or refund, within a reasonable time.

Your rights will be determined by the Australian Consumer Law and not solely by these Terms.

17. Intellectual Property

Unless otherwise stated, the website and its content are owned by or licensed to Cutout Collective.

This includes:

  • text;
  • graphics;
  • photographs;
  • product descriptions;
  • page layouts;
  • logos;
  • branding;
  • videos; and
  • website software and design elements.

You may access and use the website for personal, non-commercial shopping purposes.

You must not, without our prior written permission:

  • reproduce or republish website content;
  • commercially exploit our content;
  • copy product photography or descriptions;
  • modify or create derivative works from our content;
  • scrape or systematically extract website data; or
  • use our branding in a way that suggests an association or endorsement that does not exist.

Any third-party names, characters, images and trademarks remain the property of their respective owners and are used under licence or other lawful authority where applicable.

You are responsible for loss we reasonably incur as a direct result of your unlawful use of the website, fraud, wilful misconduct or material breach of these Terms.

This provision does not require you to compensate us for loss caused by our own conduct, negligence or breach of law.

These Terms are governed by the laws of Queensland, Australia.

You and Cutout Collective submit to the courts of Queensland and any courts entitled to hear appeals from them.

Nothing in this section prevents a consumer from exercising any right they have to bring a claim in another jurisdiction under applicable consumer law.
